This mansion replaced the decrepit family home that was demolished by 1 800 people.

It's the home from ABC's "Extreme Makeover", turning a home that was falling apart into this fancy mansion. The family borrowed money against the volunteer project, never paid it back, then put the house into foreclosure.

Heritage Listing

Hear the words "heritage listing" and it can send shivers down the spine's of property purchasers and developers. Every Friday for the next few weeks I'll discuss different aspects of heritage listed property and address some of the more common questions related to those people who are either looking to invest in a heritage listed property or presently own a heritage listed property.

Heritage listed properties are idenitfied distinctly from regular properties. There are a number of local, State and Commonwealth heritage laws that may affect heritage listed property which are not relevant to non-heritage listed property. On a federal level, the Commonwealth of Australia Parliament passed heritage legislation in September 2003 which identifies, conserves and protects places of national heritage significance. These include the Environment and Heritage Legislation Amendment Act (No 1) 2003 (Cth), Australian Heritage Council Act 2003 (Cth) and the Australian Heritage Council (Consequential and Transitional Provisions) Act 2003. Where appropriate, the relevant local or state legislation will apply to a heritage listed property.

Rent

Rent is the main charge that tenants have to pay on a regular basis. The level of rent and the method of rent payment should be agreed upon before the tenancy begins. Both should be written into the tenancy agreement in the spaces provided. Rent payments are GST free. The method of rent payment cannot be changed during the agreement period unless the tenant agrees.

Rental Bonds

A rental bond is an amount of money paid by a tenant as a form of security for the landlord against any future breaches of the tenancy agreement. Charging a rental bond is not mandatory however, the maximum rental bond that can be asked for is:

Sub Letting your Rented Place

Sub-letting is where you enter into a residential tenancy agreement and later give another person the right to occupy all or part of the rented premises, but you keep the tenancy in your own name. You would be known as the head-tenant and the person you sub-let to is called the sub-tenant. The sub-tenant’s name is not on the original agreement, but they should enter into a further residential tenancy agreement with you. Sub-letting often occurs in share housing where there is a high turn-over of tenants.

Before you can sub-let the premises you must have the written permission of the landlord/owner of the property. A landlord can refuse permission for you to sub-let, even without reasonable grounds.
